“The Copyright Law of the People’s Republic of China” was Passed and will Take Effect in June 1, 2021

  • According to CCTV News, the 23rd session of the Standing Committee of the 13th National People’s Congress (NPC) concluded at the Great Hall of the People in Beijing in the morning of November 11. After a vote, the meeting adopted a decision on revising the Copyright Law and the Law on the Protection of Veterans. The national president Xi Jinping promulgated the Presidential Order No.62 and No.63 respectively. The “Decision of the Standing Committee of the National People’s Congress on Amending the Copyright Law of the People’s Republic of China” will come into force on June 1, 2021.


    It is understood that in April and August of this year, the Standing Committee of the 13th National People’s Congress conducted the 1st and 2nd review of the draft amendments to the Copyright Law respectively, introduced a punitive compensation system for infringement, greatly increased the upper limit of statutory compensation for infringement, and improved the definition and types of works, etc.

    On November 10, the 23rd meeting of the Standing Committee of the 13th National People’s Congress conducted the 3rd deliberation on the draft amendment to the Copyright Law. It is reported that the main changes in the draft include the following aspects:


    Ø Enhancing the punishment of infringement: the lower limit of  infringement compensation is stipulated to be 500 yuan.

    Ø To fairly use copyright: adding non-profit-making restrictions

    Ø Making it clear that radio stations and TV stations have the right to prohibit acts without their permission

    Ø Specifying the ownership of the copyright of audiovisual works

    Ø Clarifying the definition of technical measures
