Administrative Protection Measures

As to domestic trademark-infringement situation, we are able to make further investigations on the targets based on our nation-wide teams and networks. What’s more,  we could contact the Administration for Market Regulation, the PSB, the FDA or other related authorities to condudct raids against those targets, or contact the customs to block the export of infringement products. Those market supervision and administration departments have the right to make following decisions:

(1) Forcing the infringer to stop his/her infringement activities immediately;

(2) Seizing or destroying infringement products, as well as tools used to produce infringement products or anti-counterfeiting lables;

(3) Forcing and supervising the infringer to destroy the infringement products once it is impossible to seperate the trademark from those products;

(4) Punishing the infringer with a fine of no more than 3 times the illegal business turnover according to the situation. And if the illegal business turnover cannot be calculated, then the infringer shoud be fined no more than RMB100,000 instead.

(5) Upon the request of the infringer, the market supervision and administration departments could also conduct mediation on the amount of the compensation.

Criminal Protection Measures

We are especially good at solving complex criminal cases, like investigating the supply chain, including big sellers, producers, package and lable suppliers, behind the infringer on E-commerce platforms. And when the investigation is over, we will file complaints to relevent authorities and help them to conduct crodd-regional raids agianst those infringers. What’s more, we are familiar with intellectual-property-protection regulations of E-commerce platforms, and also keep strong connections with intellectual-property-protection departments of every E-commerce platforms.

According to the Article 213, 214 and 215 of the Chinese Criminal Law, those who has made a bad influence for his/ her trademark-infringement activities will be sentenced to no more than 3 years’ fixed-term imprisonment or detention, along with a fine, or will be only fined without any other punishement. And those who has made serious impact will be sentenced to 3-10 years’fixed-term imprisonment with a fine.
